No further action will be taken on these issues until the contractual dispute between PCD and the turnkey contractor is resolved.
On February 2005, the ADB released its 5th semiannual report on the
implementation of the recommendations of the Board Inspection Committee
as adopted on March 25, 2002, with regard to the ADB-financed Samut
Prakarn Wastewater Management Project in Thailand. The report noted
that the civil suit filed by the Thailand Pollution Control Department
(PCD) against the turnkey contractor of the Project was rejected by the
court, and that no progress has been made on this matter.
The
report also notes that after 2 years of investigations and following
loan closure, no progress has been made on the following:
- fraud charges against several individuals associated with the acquisition of the land for the wastewater treatment plant,
- implementation of the resettlement plan,
- implementation of the monitoring systems,
- community involvement initiatives, and
- odor and effluent management.
Finally,
the report says that “no further action will be taken with respect to
these issues until the contractual dispute between PCD and the turnkey
contractor is resolved.”
